TERMS AND CONDITIONS OF BURTON ELECTRICAL & PLUMBING SOLUTIONS

1. Acceptance of Terms and Conditions
By engaging Burton Electrical & Plumbing Solutions, you (the “Customer”) agree to be bound by the terms outlined below. These terms apply solely when you accept a quotation from us. If you are not a Customer but enter into a contract for services or goods on behalf of one, these terms will still apply. These terms, along with any other conditions we specify, will govern our agreement with you from the time of acceptance.

We will ensure you receive all necessary details either within these terms, during our communications, or upon your acceptance of the quotation. 3. Interpretation
In these terms, a “Customer” refers to an individual who agrees to purchase goods or services for personal use under the Consumer Rights Act 2015. This includes anyone acting for personal purposes, not business-related activities, trade, craft, or professional work. The regulations referenced here include the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which apply to business dealings with Customers on a daily basis, except for Saturday, Sunday, or bank holidays. Unless otherwise specified, references to singular terms also include the plural, and vice versa.

4. Cancellation Rights
If we enter into a contract with you outside our standard procedures and you are not on our premises, you may have the right to cancel the agreement under the regulations. This right allows cancellation within 14 days from the date you accept the quotation, provided the goods or services have not yet been delivered. However, if you request immediate delivery or services within this period, this right may no longer apply. If cancellation occurs after we have started the work, you may need to pay for any services already provided, as outlined in the regulations. Your cancellation rights will be detailed further in our communications with you.

5. Scope of Goods and Services
The goods and services we provide will include all items and tasks specified in your accepted quotation. Any descriptions provided are for identification purposes only and are not part of the contract unless explicitly stated. All goods and services are subject to the terms of this agreement and comply with regulations applicable to you as a Customer.

6. Pricing
The cost of goods and services (the “Price”) will be outlined in the quotation provided by Burton Electrical & Plumbing Solutions. Unless specified otherwise, this Price is an estimate based on the scope of work. Additional charges may apply for factors beyond our control, such as increased material costs, labor, or delivery rates. We will confirm any changes to the Price before proceeding. Unless otherwise stated, the Price excludes VAT and other applicable taxes, which will be added as required by law.

7. Quotation and Formation of Contract
Any quotation we provide does not constitute a binding offer. A contract is formed only when you accept our quotation in writing or verbally, and we confirm acceptance. If you are not a Customer, these terms will still apply for the purchase of goods or services. Quotations remain valid for a specified period, after which they may be withdrawn or revised.

8. Payment
Payment for goods or services must be made in accordance with the payment terms specified in your quotation or invoice. You must settle the full amount within the agreed timeframe. If payment is not received by the due date, Burton Electrical & Plumbing Solutions reserves the right to charge interest on overdue amounts, as permitted by law.

9. Delivery
We will arrange delivery of goods or provision of services as soon as reasonably possible after your acceptance of the quotation. Delivery will occur within 30 days unless otherwise agreed, to the address you specify or another agreed location. You are responsible for ensuring access for delivery.

10. Risk and Ownership
The risk of damage or loss of goods transfers to you upon delivery. However, ownership of the goods remains with Burton Electrical & Plumbing Solutions until full payment is received. We retain the right to reclaim goods if payment is not made as agreed.

11. Liability and Damages
Burton Electrical & Plumbing Solutions is not liable for damages caused by unforeseen circumstances beyond our control, such as failure to access your property, damage caused by third parties, or loss of business profits. Our liability is limited to the value of the goods or services provided. We do not exclude liability for death or personal injury caused by our negligence, fraud, or breaches of consumer rights under applicable laws, including the Consumer Rights Act 2015.

12. Data Protection

13. Communications
All communications related to this agreement will be in writing, either by post, email, or through our website. Notices must be sent to the contact details provided by each party. We will consider notices delivered once they are sent, provided they are sent to the correct address.

14. Force Majeure
Burton Electrical & Plumbing Solutions will not be liable for delays or failures in performing our obligations due to events beyond our reasonable control, such as natural disasters or other unforeseen events.

15. No Waiver
If we do not enforce any provision of these terms, it does not mean we waive our right to enforce that provision in the future. Any waiver must be explicitly agreed in writing.

16. Severance
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

17. Complaints

18. Law and Jurisdiction

20. Diagnostics

Any guarantees provided by Burton Electrical & Plumbing Solutions will be detailed in writing. These guarantees do not affect your statutory rights.

22. Time Limits
Any timeframes provided for delivery or services are estimates only. We will not be liable for delays beyond our control.

23. Termination and Suspension
We reserve the right to terminate or suspend our services if you fail to meet your obligations under this agreement. We will notify you in writing of any such action.
